1. Acceptance of Terms

By creating an account or using Colyst ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Colyst provides AI-powered content generation tools for real estate professionals, including image transformation, virtual staging, and listing copy. Features are subject to change without notice.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

4. Credits and Payments

Credits are purchased in advance and consumed when generating content. Credits are non-refundable except where a generation fails, in which case credits are automatically returned to your balance. Credits purchased on the Colyst platform have a limited validity period. Unused credits will expire as outlined in your account dashboard and any applicable promotional terms. Colyst reserves the right to modify credit expiration policies with reasonable notice to users. Expired credits are non-refundable.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose, to infringe third-party intellectual property rights, or to upload content you do not have the right to use. We reserve the right to suspend accounts that violate these terms.

6. User Responsibility for Generated Content

Colyst provides AI-generated content as a tool for your use. You, the user, are solely responsible for how you use, publish, distribute, or represent any content generated on our platform.

By using Colyst, you acknowledge and agree that:

• You are responsible for ensuring that all content you publish or distribute complies with applicable laws, regulations, and industry standards including but not limited to fair housing laws, real estate advertising regulations, and consumer protection legislation.
• AI-generated images, including but not limited to virtual staging, twilight conversions, and item removal, are digitally altered representations and must be disclosed as such in any listing or marketing material where required by law or professional standards.
• Colyst accepts no liability for any claims, penalties, fines, disciplinary actions, or damages arising from your use of AI-generated content, including but not limited to claims of false advertising, misrepresentation, or breach of professional obligations.
• You indemnify and hold harmless Colyst, its directors, employees, and affiliates from any claims arising from your use or misuse of content generated on our platform.

7. Intellectual Property

You retain ownership of all images and content you upload. By uploading content you grant Colyst a limited licence to process that content solely for the purpose of delivering the Service to you.

8. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. We do not guarantee that outputs will meet your specific requirements or be error-free.

AI-generated content is subject to the inherent limitations and variability of artificial intelligence technology. Colyst does not guarantee that any generated content will meet your specific expectations, requirements, or standards of quality. Dissatisfaction with the aesthetic outcome, style, or result of an AI generation does not constitute grounds for a refund or credit. Credits are consumed upon submission of a generation request regardless of the outcome. Refunds are only issued in the event of a verified technical failure on our platform.

9. Limitation of Liability

To the maximum extent permitted by law, Colyst shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
